NOTICE OF PROPOSED DECISION
The Colorado Division of Reclamation, Mining and Safety proposes to approve Permit Revision Application No. 6, submitted by Snowcap Coal Company, Inc for a coal mining permit at the Roadside Portals (Permit No. C-1981-041). Snowcap Coal Company (SCC) is requesting to change the post mining land use at the Roadside North Portal, Cameo Refuse Disposal Area 1, Cameo Borrow Areas 1 & 2, and Ponds 6, 10, 11 and 13. The post mining land use at these areas is fish and wildlife and will be changed to commercial/industrial.
The Roadside Portals is a/an underground operation located in Mesa County, approximately 5 miles North of Palisade, Colorado. Coal interest is federal and private, and the surface to be affected is federal and private land. The permit area encompasses approximately 732.50 acres.
This proposed decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34 33 101, et seq., C.R.S., and the regulations promulgated thereunder.
Copies of the proposed decision, including any stipulations, are on file for public inspection at the Colorado Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, Denver, Colorado 80203 and Mesa County Clerk and Recorder, 200 S. Spruce Street, Grand Junction, CO 81501. Persons with an interest that may be adversely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such request must be made within thirty (30) days of the initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for the request and the objections to the proposed decision.

NOTICE OF PROPOSED DECISION
The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to partially approve Bond Release Application No. 9 (SL-9) for the Roadside Portals, Permit No. C-1981-041. The underground operation is operated by Snowcap Coal Company, Inc under the provisions of the Colorado Surface and Coal Mining Reclamation Act of 1979. The bond release application was submitted by Snowcap Coal Company, Inc. on August 15, 2016. This proposed decision will release the applicant from Phase II liability on 13.1 acres and from Phase III liability on 9.6 acres. Also, the proposed decision will terminate Division jurisdiction on 0.2 acres of undisturbed land overlying underground workings. The specific areas to which this bond release request applies is included within the Permit Boundary and are located as follows:
T10S, R98W, 6th P.M.:
Section 27: Portions of S1/2, SW1/4
Section 28: Portions of SE1/4
Section 34: Portions of SW1/4 and portions of NE1/4, NE1/4
With the approval of SL-09 application, the Division proposes to release $97,202.20 of financial liability. A copy of the SL-09 bond release application and the Division's Proposed Decision and Findings of Compliance document for the SL-09 application is available for public inspection at the Mesa County Clerk and Recorder's office, 200 S. Spruce, Grand Junction, CO. The affected area is located in Mesa County, approximately 5 miles North of Palisade, Colorado. Petitioners, WILLIAM AND DENA PELTER, having filed with this Court a verified Petition to Terminate Parent-Child Relationship between MADELINE RENEE BARBEE and her natural mother, HEATHER ANNE BARBEE, presumed legal father, CASEY BARBEE, and potential fathers, KENNETH ROBERT ALLEN, IAN LYKE CHADWICK and JOHN DOE.
NOTICE IS HEREBY GIVEN that a hearing on the Petition to Terminate Parent-Child Relationship is scheduled for the 20th day of December, 2016, at the hour of 2 o'clock, p.m., before the Honorable Veronica Brame in the Maricopa County Superior Court, Juvenile Division located at: 1810 South Lewis, Mesa, Arizona 85210, for the purpose of determining whether any parent named herein is contesting the allegations in the Petition for Termination.
You have a right to appear as a party in this proceeding. The failure of a parent to appear at the initial hearing, the pretrial conference, the status conference or the termination adjudication hearing without good cause may result in an adjudication terminating the parent-child relationship of that parent.
Failure to appear at a hearing may result in a finding that the parent has waived legal rights, including the right to trial to a jury, and is deemed to have admitted the allegations in the motion or petition for termination. The parent shall be advised that the hearings may go forward in the absence of the parent and may result in the termination of parental rights based upon the record and evidence presented.
In the event a named parent appears and enters a contest to the allegations, a trial will be scheduled for a later date. If a named parent does not contest the allegations, then that parent's rights shall be terminated on the above date and time.
The above-named individual may obtain a copy of the Notice of Hearing and Petition to Terminate Parent-Child Relationship by submitting a written request to: Kristy B. Blackwell, Attorney at Law, 1490 S. Price Rd, Ste. 318, Chandler, AZ 85286.
At the initial hearing, an attorney will be appointed to represent any parent named herein if the parent wants a lawyer and if the parent cannot afford to hire one. That parent will be required to sign a financial affidavit and may be required to pay some or all of the cost of the attorney.
A request for reasonable accommodation for persons with disabilities must be made to the Court by parties at least three (3) working days in advance of a scheduled court proceeding.
