The scope of the work consists of roof replacement, venting, gutters, porch and ceiling repair, repointing and repairing chimney, ceilings and wall replacement, exterior wall and trim repair, replacement of a bedroom window in kind, replacement of rear side entry stairs and exterior painting.

As a result of this environmental review, the City has determined that the undertaking of this project will not constitute, adversely, an action significantly affecting the quality of the human environment. No further environmental review will be conducted for this project prior to the request for release of funds from HUD.

The facts and reasons for this decision are as follows. The renovation will help create a more stable community as well as eliminate blighting influences and environmental deficiencies, substantially improve the visual appearance and image of the neighborhood. The identified potential negative impacts appear to be primarily short-term site preparation and related staging activities, which will generate increased vehicle emissions, fugitive dust, and increased noise levels. These are short-term impacts that will have a minor effect on the environment, and are not significant in magnitude or effect. City codes and proper building/construction practices will mitigate potential adverse impacts due to project activities. There are no actions that will be undertaken in either implementing the initial components of the project, or in the long term, which would have a significant adverse impact on the environment.

An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file, and available for review, at the City of Buffalo Office of Strategic Planning and the Permit and Inspections Office, Marty Grunzweig (716-851-5085), Room 920 City Hall, Buffalo, New York, 14202. Any individual, group, or agency may submit written comments on the ERR to the City at the above address. All comments regarding the Notice of No Significant Impact received by October 6, 2017 will be considered by the City of Buffalo, Mayor Byron W. Brown, prior to authorizing submission of a request for release of funds.

The City of Buffalo Chief Executive Officer, Mayor Byron W. Brown, will submit a Request for Release of Funds and Certification for this project to the U.S. Department of Housing and Urban Development (HUD) on or about October 10, 2017 .These documents are required in order to facilitate the undertaking of an action included in City's application for funding under Title I of the U.S. Housing & Urban Development Act of 1974 (PL 93-383). The City is certifying to HUD that Byron W. Brown, in his capacity as Mayor, consents to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to the environmental review process, and that these responsibilities have been satisfied. The legal effect of the certification is that upon approval, the renovation of 196 Hughes Buffalo New York may be undertaken and the City and HUD will have satisfied their responsibilities under NEPA and related laws and authorities.

HUD will accept objections to its approval of the release of funds and the City's certification for a period of fifteen (15) days following the anticipated submission date, or HUD's actual receipt of the request (whichever is later), only if they are on one of the following basis: (a) that the certification was not, in fact, executed by the authorized Certifying Officer of the City; (b) the city has omitted a step, or failed to make a decision or finding, required as per the procedures under 24 CFR Part 58; (c) the grant recipient has committed funds, or incurred costs, not authorized by 24 CFR Part 58 before the approval of a release of funds request by HUD; or, (d) when another Federal agency, acting pursuant to 40 CFR Part 1504, has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.

Objection to the release of funds must be prepared and submitted in accordance with the required procedure (24 CFR, Part 58) and should be addressed to HUD at the Buffalo Area Office, Lafayette Court, 465 Main Street, Buffalo, New York, 14203 (with a copy to the City of Buffalo Office of Strategic Planning). HUD has until October 26, 2017 to consider any objections, and can only release program funds after that date. Potential objectors should contact HUD to verify the actual last day of the objection period.
