Pursuant to the Pennsylvania Clean Streams Law, the Pennsylvania Department of Environmental Protection Rules and Regulations, the Surface Mining Conservation and Reclamation Act, and the Bituminous Mine Subsidence and Land Conservation Act as amended, notice is hereby given that Consol Pennsylvania Coal Company LLC, 1000 Consol Energy Drive, Canonsburg, PA 15317, is making application to the Pennsylvania Department of Environmental Protection to revise Coal Mining Activity Permit (CMAP) No. 30841316 and related NPDES permit for the Bailey Mine.

The proposed revision adds 2,510 acres of the underground permit area and subsidence control plan area for underground development mining only.

The revision to the permit area and subsidence control plan area for development mining begins at a point approximately 5500 feet northwest of the intersection of Behm Rd. (SR 3018) and Finch Rd. (T351) then approximately 5000 feet southwest to a point approximately 500 feet northwest of the intersection of Behm Road. (SR-3018) and Aleppo Rd. (SR 3001) then approximately 4000 feet northwest to a point approximately 4750 feet northwest of Behm Road (SR-3018) and Aleppo Rd. (SR 3001) then approximately 2500 feet southwest to a point approximately 5100 feet southwest of Behm Road (SR-3018) and Aleppo Rd. The proposed permit area encompasses 900 acres for construction of Coal Refuse Disposal Area No. 7. The facility will be located in Morris Township, Greene County; in the valley located along Rush Run Road (formerly SR 4009), from its intersection with Valley Church Road (formerly SR 4013) and continuing to the northeast to its intersection with SR 4015 (Webster Road). Beginning near the Rush Run Road/Valley Church Road intersection, the proposed permit area extends approximately 10,000 feet to the northeast; with an average width of approximately 4,000 feet. The proposed permit area is located on the Wind Ridge and Rogersville, PA U.S. Geological Survey 7.5 minute topographic maps.

Stream variance requests are proposed for 13,338 feet of Unnamed Tributary 32758 to Enlow Fork beginning near the intersection of Valley Church Road (formerly SR 4013) and Rush Run Road (formerly SR 4009) and extending northeast through the proposed site; and 39,585 feet of 109 other Unnamed Tributaries to Enlow Fork that flow into Unnamed Tributary 32758 to Enlow Fork along this reach. The stream variances are required for grading activities, construction of the coal refuse facility, sedimentation ponds, installation of erosion and sediment control facilities, and support areas.

The application includes a request for variance to encroach within 100 feet of the right of way of the following public roads:

A 2,980 foot section of Webster Road (SR 4015) beginning approximately 1,540 feet south of its intersection with SR 18 and continuing to the south.

Approximately 260 feet of Mankey Road (T-426) starting at the intersection with SR 4015 (Webster Road) and continuing to the east.

A 3,430 foot section of Powers School Road (T-603) beginning near its intersection with Crouse Road (T-392) and Valley Church Road (T-605) and continuing in an easterly direction. It is planned that this portion of Powers School Road will be relocated by others prior to project construction.

The road variances are required for placement of the refuse material, sediment pond construction, installation of erosion and sediment control facilities, support areas, and contractor staging areas.

The proposed permit application includes two new NPDES discharge points into UNT 32758 to Enlow Fork and one new NPDES point for UNT 40577-L7 to Browns Creek. The proposed NPDES discharge points discharge flow from sedimentation ponds. NPDES Outfall 701 will be located on UNT 32758 to Enlow Fork, approximately 150 feet southwest of the Valley Church Road/Crous Road Intersection. NPDES Outfall 702 will be located on UNT 32758 to Enlow Fork, approximately 320 feet southwest of the Valley Church Road/Crous Road Intersection. NPDES Outfall 703 is located upstream of UNT 40577-L7 to Browns Creek, approximately 470 feet south of the SR 4015 (Webster Road)/Mankey Road (T-426) intersection.

Blasting may be conducted during site grading activities. Blasting will not occur until a plan has been approved by the PADEP. When a blasting schedule is finalized, residents, owners of dwellings or other structures, local governments and public utilities located within mile of the area where blasting will occur will be notified. All residents, owners of dwellings or other structures located within mile of the area where blasting will occur will be informed of their right to a pre-blast survey and how they may request such a survey.

INVITATION FOR BIDS

The Redevelopment Authority of the County of Washington (RACW) will receive bids for the LONG BRANCH STREET IMPROVEMENTS PROJECT NO. CD 16-12 until 10:00 A.M., prevailing time, on March 3, 2017, at its office, 100 West Beau Street, Suite 603, Washington, Pennsylvania 15301, at which time and place all bids will be publicly opened and read aloud.

Copies of the contract documents including drawings, technical specifications and bid forms, may be obtained at Harshman CE Group, 100 Courson Hill Road, Washington, PA (724-825-5577). A non-refundable payment of $50.00 payable to Harshman CE Group for each set of contract documents is required.

Each bid shall be accompanied by a bid guaranty, which shall not be less than ten percent (10%) of the total amount of the bid. The form of the guaranty shall be in accordance with the type permitted under the contract documents.

Attention is called to the fact that not less than the minimum salaries and wages as set forth in the Contract Documents must be paid on this project; that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, age, color, religion, sex, national origin, or handicap in accordance with Executive Order 11246; and that the lower income resident employment and training requirements 24 CFR 135 apply to this project.

The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 170lu (Section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD assisted projects covered by Section 3, shall, to the greatest extent feasible, be directed to low and very low income persons, particularly persons who are recipients of HUD assistance for housing.

The requirements of Executive Order 11625 Minority Business Enterprise, and Executive Order 12138 Women Business Enterprise, are applicable to this project.

As used in this Notice, and in the contract resulting from this solicitation, the "covered area" is the Pittsburgh Metropolitan Statistical Area (MSA) which includes the Counties of Allegheny, Beaver, Butler, Fayette, Washington and Westmoreland. All bidders are required to contact Section 3 Business concerns in the Pittsburgh MSA.

The RACW reserves the right to reject any or all bids or to waive any informality in the bidding.

Bids may be held by the RACW for a period not to exceed 45 days from the date of opening of Bids for the purpose of reviewing the Bids and investigating the qualifications of Bidders, prior to awarding of the contract.

In no event will the RACW consider a contractor as eligible if he cannot initiate the work under the contract within 15 days of the contract execution and proceed to the successful completion of the work within 30 consecutive calendar days of the Notice to Proceed.

Attention is called to the fact that not less than the minimum salaries and wages as set forth in the Contract Documents must be paid on this project; that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, age, color, religion, sex, national origin, or handicap.

RACW reserves the right to reject any or all bids or to waive any informality in the bidding.
