You are hereby summoned to answer the complaint in this action and to serve a copy of your answer, or if the complaint is not served with this summons, to serve a notice of appearance on the Plaintiff's attorneys within thirty days after the service of this summons, exclusive of the day of service, and in case of your failure to appear or answer, judgment will be taken against you by default for the relief demanded in the complaint.

The foregoing summons is served upon you by publication pursuant to an order of Honorable Jeremiah J. Moriarty III, Justice of the Supreme Court of the State of New York, signed the 25th day of July, 2019 at Little Valley, New York.
The object of this action is to foreclose a mortgage on the following property:
Tax I.D. No. 92.004-1-6.2
ALL that certain parcel of land situate in the Town of Carrollton, County of Cattaraugus, State of New York, being a part of Lot 16, Township 1, Range 6 of the Holland Land Company Survey, bounded and described as follows:
BEGINNING at the point of intersection of the centerline of Chipmunk Road and the South Nine Mile Road (County Route No. 30);
THENCE North 83 degrees 31 minutes 46 seconds East, along the center of the South Nine Mile, a distance of 128.05 feet to an angle point therein;
THENCE North 89 degrees 25 minutes 54 seconds East a distance of 57.90 feet to a point;
THENCE, leaving said centerline, South 01 degrees 42 minutes 25 seconds West, passing through an iron pin set at or near the southerly bounds of said road, a distance of 163.93 feet to an iron pin set;
THENCE North 87 degrees 07 minutes 43 seconds West, passing through an iron pin set at or near the easterly bounds of Chipmunk Road, a distance of 187.54 feet to the centerline of Chipmunk road;
THENCE North 02 degrees 57 minutes 17 seconds East, along the center of Chipmunk Road, a distance of 140.0 feet to the point and place of BEGINNING.
The description is in accordance with a survey map prepared by Robert C. Ackerman, Surveyor, dated April 19, 1996.
EXCEPTING THEREFROM:
Those lands as described in Deed recorded on 7/27/2012 in Instrument # 181275-003.
Subject to easements, covenants, and restriction of record.
These premises are also known as 5281 Nine Mile Road a/k/a 5281 South Nine Mile Road a/k/a 5281 S. Nine Mile Road, Allegany, NY 14706.
