Steuben Foods, Inc., and/or Individual(s) or Affiliate(s), Subsidiary(ies), or Entity(ies) formed or to be formed on its behalf (the "Company"), has submitted an application to the Agency (a copy of which is on file at the office of the Agency) requesting the Agency to undertake a certain project (the "Project") consisting of: (i) the construction and equipping of a warehouse building addition totaling 82,500+/- SF to be utilized as drive-in racking to improve and increase production and the expansion of the parking lot for added employee parking spaces and tractor trailer staging located at 1150 Maple Road, Town of Elma, Erie County, New York (the "Improvements"); and (ii) the acquisition and installation by the Company of certain items of machinery, equipment and other tangible personal property (the "Equipment"); and, collectively with the Improvements, the "Facility").

The Agency will acquire a leasehold interest in the Facility and lease the Facility back to the Company. The Company will operate the Facility during the term of the lease. At the end of the lease term, the leasehold interest will be terminated. The Agency contemplates that it will provide financial assistance to the Company for qualifying portions of the Project in the form of sales and use tax exemption benefits and real property tax abatement benefits consistent with the policies of the Agency.

A representative of the Agency will be present at the above-stated time and place to present a copy of the Application and hear and accept written and oral comments from all persons with views in favor of or opposed to the proposed financial assistance. Written comments may be submitted at this public hearing or delivered to the Agency at 95 Perry Street-Suite 403, Buffalo, NY 14203 until the comment period closes on March 26, 2019. The selected site is located in close proximity to mid-town Buffalo and near a wide range of services, including retail shops and recreational areas. The site is served by the Niagara Frontier Transportation Authority (NFTA) with nearby stops on Jefferson Avenue, Sycamore Street and Broadway. A meeting seeking the community's input on the project was held on Thursday, May 5th 2016 at the Buffalo Federation of Neighborhood Centers (BFNC).

As a result of this environmental review, the City has determined that the undertaking of this project will not constitute, adversely, an action significantly affecting the quality of the human environment. No further environmental review will be conducted for this project prior to the request for release of funds from HUD.

The facts and reasons for this decision are as follows. The Westminster Commons project will help create a more stable community as well as eliminate blighting influences, substantially improving the visual appearance and image of the neighborhood. Potential negative impacts appear to be primarily short-term site preparation and related staging activities, which generate increased vehicle emissions, fugitive dust and increased noise levels. These are short-term impacts that will have a minor effect on the environment, and are not significant in magnitude or effect. City codes and proper building/construction practices will mitigate potential adverse impacts due to project activities. There are no actions that will be undertaken in either implementing the initial components of the project, or in the long term, which would have a significant adverse impact on the environment.

An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file and available for review, at the City of Buffalo Office of Strategic Planning, Samantha Long (716-851-6587), Room 616 City Hall, Buffalo, New York, 14202. The Erie 2 Chautauqua-Cattaraugus BOCES reserves the right to waive any informalities in and to reject any or all bids submitted.

A Bid Bond or Certified Check in amount of ten percent (10%) of Base Bid is required and must accompany proposal. Performance Bond and Labor Material Payment Bond equal to one hundred percent (100%) of contract sum are required to be delivered at time contract is signed with Owner.

Attention of bidders is called to requirements for conditions of employment to be observed and prevailing wage rates to be paid, and requirements pertaining to certification of Non-Collusion in preparation of proposals submitted for this project.

No bidder may withdraw his bid within forty-five (45) days after date of opening.
