Proposals are requested by the Erie County Department of Environment and Planning, Division of Sewerage Management (DEP/DSM) for engineering consultant services to provide assistance with air permit requirements for the Southtowns Advanced Wastewater Treatment Facility. The top rated respondent will be selected to enter into an agreement to provide the services.

In accordance with Local Law No. 6, proposals are hereby invited for the subject project. Proposals are to be submitted in the exact format detailed in the request for proposals (RFP). Proposals will be due at 4:00 PM on October 25, 2018. Proposal shall be delivered to the DEP/DSM, Room 1034, 95 Franklin St., Buffalo, NY 14202.

REQUEST FOR RELEASE OF FUNDS

On or about September 27, 2018, the New York State Homes & Community Renewal (HCR), through the New York State Housing Trust Fund Corporation (HTFC), will submit a request to U. S. Department of Housing and Urban Development (HUD) for the release of $883,125 in HOME funds under Title II of the Cranston-Gonzalez National Affordable Housing Act (NAHA) of 1990, in accordance with section 288 (42 U.S.C. 12838), to authorize Delta Development of WNY to undertake a project known as St. Patrick Village Apartments 2017, for purposes of renovating 10 townhomes at St. Patrick Village in the City of Buffalo located at 39 Emslie Street, Buffalo, NY. Rehabilitation will include new heating mechanicals, appliances, kitchens, lighting, new siding, and windows and doors in all 10 units. All units will be fitted with adaptions for residents with visual impairments and six will be equipped for mobility-impaired residents with an estimated total project cost of $883,125.

The activities proposed are Categorically Excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at:

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to Heather Spitzberg, either by mail to Environmental Analysis Unit, NYS Housing Trust Fund Corporation, 38-40 State Street, Albany, New York, 12207 or by Email to heather.spitzberg@nyshcr.org. All comments received by September 26, 2018 will be considered by HCR prior to authorizing submission of a request for release of funds.

ENVIRONMENTAL CERTIFICATION

HCR certifies to HUD that Ms. Heather Spitzberg, Esq., in her capacity as Certifying Officer consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HCR's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows Delta Development of WNY to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will consider objections to its release of funds and HCR's certification received by October 12, 2018 or for a period of fifteen days following its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of HCR; (b) HCR has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to
