NOTICE is hereby given that there were filed in the office of the Department of Transportation on the 18th day of July, 2017, description and original tracing of a map, together with a certificate as to the accuracy thereof, of property which the Commissioner of Transportation deemed necessary to be acquired immediately for purposes connected with the project identified above that; there was filed in the office of the ERIE County Clerk on the 17th day of August, 2017, a copy of such description and map, whereupon the appropriation by the State of the property
described in such description and map became complete and the title to such property vested in the People of the State of New York.

Description and map of property which the Commissioner of Transportation deems necessary to be acquired by appropriation in the name of the People of the State of New York for purposes connected with the highway system of the State of New York pursuant to Section 30 of the Highway Law and the Eminent Domain Procedure Law.

There is excepted from this appropriation all the right, title and interest, if any, of the United States of America, in or to said property.

That the following is a description of such property, to wit:

PERMANENT EASEMENT FOR HIGHWAY PURPOSES AND STREAM CHANNEL

A permanent easement to be exercised in, on and over the property above delineated for the purpose of constructing, reconstructing and maintaining thereon a State Highway and stream channel, together with such bridges and appurtenances, in and to all that piece or parcel of property designated as Parcel No. 132, as shown on the accompanying map and described as follows:

Beginning at a point on the northwesterly highway boundary of the Akron - Tonawanda Creek,

S.H. 947 as delineated on Parcel 63 of Map 62 which was filed in the Erie County Clerk's Office on February 02, 1959, said point being the southeast comer of Parcel 123 of Map 119 which was filed in the Erie County Clerk's Office on January 08, 1960, said point also being 55 feet distant northwesterly measured at right angles from Station 11+89 of the hereinafter described 2016 Survey Baseline for the reconstruction of a portion of the Akron - Tonawanda Creek, S.H. 947; thence northwesterly along the southerly boundary of said Parcel 123, 16 feet to a point, said point being 71.17 feet distant northwesterly measured at right angles from Station 11+90 of said baseline; thence through the property of Kathryn A. Capan (reputed owner), South 09deg.46'23" East, 26 feet to a point on said northwesterly highway boundary, said point being 56 feet distant northwesterly measured at right angles from Station 11+68.31 of said baseline; thence northeasterly along said northwesterly highway boundary, 21 feet to the point of beginning, being 171 square feet or 0.004 acres, more or less.

RESERVING, however, to the owner of any right, title or interest in and to the property above delineated, and such owner's successors or assigns, the _right of access and the right of using said property and such use shall not be further limited or restricted under this easement beyond that which is necessary to effectuate its purposes for, and as established by, the construction or reconstruction and as so constructed or reconstructed, the maintenance, of the herein identified project.

The above mentioned survey baseline is a portion of the 2016 survey baseline for the reconstruction of Akron-Tonawanda Creek, S.H. 947, as shown on the map above and in the survey files in the Office of the Department of Transportation and described as follows:

Beginning at Station 10+00.00; thence North 24deg.40'27" East to Station l 5+45.90.

All bearings referred to True North at the 78deg.35' Meridian of West Longitude.

Said order appears as part of Subchapter A of Chapter IV of Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York and provide that:
(1) No person shall use dust forms of 2,4-D; 2,4,5-T or MCP within the above-named townships.

(2) No person shall use ester formulations of
2,4-D; 2,4,5-T or MCP within said townships or within two miles of the boundaries of any grape vineyard located in whole or in part within said townships.

(3) No person shall apply any spray of 2,4-D; 2,4,5-T or MCP within the said townships at a rate of application less than 15 gal. per acre nor at a nozzle pressure exceeding
40 lbs. per square inch nor within 100 feet of any grape vineyard located in whole or in part within said townships.

The said order shall continue in effect unless a petition for modification or rescission is filed with the undersigned Conunissioner on or before March 1, 2018. Such petition must be signed by ten or more grape growers or fifty or more persons not grape growers within the townships affected by any particular order. If such petition is duly filed, a hearing thereon will be conducted and a determination made pursuant to the provisions of
