SNOHOMISH COUNTY COUNCIL SNOHOMISH COUNTY, WASHINGTON NOTICE OF INTRODUCTION OF ORDINANCE and NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN, that the Snohomish County Council will hold a public hearing on May 19, 2021, at the hour of 10:30 a.m., via Zoom to consider proposed Ordinance No. 21-024. Background: This ordinance proposes to accept a statutory warranty deed and establish county road 21st Avenue West through Dawson Place Single-Family Detached Unit (SFDU) development. ORDINANCE NO. 21-024 AN ORDINANCE ACCEPTING STATUTORY WARRANTY DEED AND ESTABLISHING 21ST AVENUE WEST AS A NEW COUNTY ROAD Section 1. Adopts findings of fact. Section 2. Finding that RMH LLC intends to deed property described in Section 6 for the use of the public in perpetuity and that a statutory warranty deed has been executed and submitted to accomplish the same. Section 3. Provides the full legal description and establishes the road as County road right-of-way subject to full County authority and discretion. Section 4. Provides that RMH LLC shall construct the road to County design standards at its own expense and will post a two-year maintenance security. Section 5. Finding that the proposed road right-of-way is a public necessity, is practicable, and the public will be benefited by the establishment of 21st Avenue West. Section 6. Authorizes the Snohomish County Executive to accept the deed on behalf of Snohomish County. Section 7. Provides that establishment of County right-of-way is not effective until: (1) the Department of Public Works (“DPW”) files a certification with the Clerk of the Council stating administrative and advertising costs are paid; and (2) PDS and DPW has inspected and accepted final construction of the roads; (3) RMH LLC has submitted a two-year maintenance security; and (4) the statutory warranty deed has been recorded. At the hearing, the Council may also consider alternatives/ amendments to the proposed ordinance.
