SUCCESSOR TRUSTEE'S NOTICE OF FORECLOSURE SALE
WHEREAS, default having been made in the payment of the debts and obligations secured to be paid by that certain Deed of Trust dated December 20, 2013, executed by Twin Willows Construction LLC, a Tennessee limited liability company, to Travis Edmondson, Trustee, as same appears of record in the Register's Office of Knox County, Tennessee, as Instrument No. 201312230038791, and Mesana Investments, LLC, the current holder of said Deed of Trust, appointed Lewis S. Howard, Jr. as Successor Trustee pursuant to that certain Appointment of Successor Trustee dated April 25, 2019 and recorded in the Register's Office of Knox County, Tennessee as Instrument Number 201904300063616 with all the rights, powers and privileges of the original Trustee named in said Deed of Trust.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust and that the Successor Trustee, or his duly appointed attorneys or agents, by virtue of the power and authority vested in him will on Monday, June 3,
2019, at 11:00 a.m. local time, inside the Main Street entrance of the Knoxville City-County Building in Knox County, Tennessee, proceed to offer for sale and sell at public outcry to the highest and best bidder for cash or on such terms as may be announced at the sale, the following
described real property:
Legal description: Being the same property described in that certain Warranty Deed dated
December 20, 2013 and recorded as Instrument No. 201312230038790 in the Register's Office of Knox County, Tennessee.
Common description: Being a part of Tax Map 129, Parcel 142.
Other interested parties: Adam L. Hutsell; Lawrence R. Hutsell; Wesley E. Rhoden; Firstbank; Liftfund, Inc.; Can Capital Asset Servicing Inc.; Stowers Rental & Supply, Inc.; Broadway Carpets, Inc.; FB Funding, LLC d/b/a Fast Business Funding; Direct Capital Corporation; Ferguson Enterprises, Inc.; Farmer Garage Door Company; Evelyn and Josh Hood; Dennis Osland; Thomas Rhoden; Ready Mix USA, LLC; Zach and Mary Shanley; 84 Lumber Company, L.P.
All right of equity of redemption, statutory and otherwise, and homestead are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Successor Trustee.
The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes, any restrictive covenants, easements or set-back lines that may be applicable; any statutory rights of redemption of any
governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and any matter that an accurate survey of the premises might disclose.
The sale held pursuant to this Notice may be rescinded at the Successor Trustee's option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication and in accordance with law, upon announcement of such adjournment
on the day and at the time and place of sale as set forth above.
The proceeds of the sale will be applied first to discharge the costs and charges of executing this trust, including attorney's fees; next, to all indebtedness remaining unpaid and secured thereby by the grantor; and next, the balance, if any, shall be paid to those legally entitled thereto.
