Pursuant to the PENNSYLVANIA CLEAN STREAMS LAW, the PENNSYLVANIA DEPARTMENT OF ENVIRONMENTAL PROTECTION Rules and Regulations, the SURFACE MINING CONSERVATION and RECLAMATION ACT, and the BITUMINOUS MINE SUBSIDENCE and LAND CONSERVATION ACT as amended, notice is hereby given that Emerald Contura, LLC, doing business at P.O. Box 1020, 158 Portal Road, Waynesburg, Pennsylvania 15370, has made application to the Pennsylvania Department of Environmental Protection to revise the mining permit and related NPDES permit to add surface activity site acres for the construction of the West Pool Pipeline Extension and associated EM#4 Pump Borehole pad as well as the existing EM#5 Pump Borehole Site for the Emerald Mine (Permit No. 30841307).

The proposed permit revision will affect 41.34 acres in Center and Franklin Townships, Greene County, Pennsylvania. The proposed pipeline extension route would originate at a location along the permitted West Pool Pipeline (80 13 24.98 Longitude and 39 50 24.09 Latitude), approximately 3,526 feet southeast of the intersection of Oak Forest Road and Hoy Hill Road and end at the existing Emerald Mine CRDA #2 Site located south of Waynesburg, Pennsylvania (80 12 28.62 Longitude and 39 53 11.25 Latitude). The pipeline will traverse approximately 4.1 miles through Franklin Township in Greene County, Pennsylvania. Multiple construction access points to the pipeline project area will be from Whites Ridge Road (T-724) and Portal Road (T-487).

The proposed EM#4 Pump Borehole pad area can be located on the Oak Forest, Pennsylvania U.S.G.S 7.5 minute series topographic map, at approximate 80 13 06.11 Longitude and 39 51 50.29 Latitude. The small borehole pad site is proposed for the construction of two pump boreholes EM#4A (80 13 06.57 Longitude and 39 51 50.63 Latitude) and EM#4B (80 13 05.51 Longitude and 39 51 50.26 Latitude), and supporting facilities relative to the existing Emerald Mine. Access to the site will be from Portal Road (T-487).

The existing 0.97-acre EM#5 Pump Borehole Site is located approximately 2,000 feet northeast of the village of Oak Forest, on a tract of land bounded by Township Road 473 (Hoy Hill Road) on the north, State Road 3013 (Oak Forest Road) on the west, and Township Road 492 (Stewart Run Road) on the south. It can be located on the Oak Forest, Pennsylvania U.S.G.S 7.5 minute series topographic map, at approximate 80 13 48.41 Longitude and 39 50 40.51 Latitude and is located associated with the West Pool Pipeline. It was permitted and constructed by Cumberland Contura, LLC under the Cumberland Mine (Permit No. 30831303, Revision No. 180). This site is being added to the Emerald Mine permit through the permit revision application.

The proposed waterline, EM#4 borehole pad and access road, storm water collection channels, and temporary erosion and sedimentation BMPs (compost filter sock) will be located within 100 feet of the right-of-way for Whites Ridge Road (T-724), Randy Hoge Road (T-475), Greenhouse Road (T-510), and Portal Road (T-487). Emerald Contura, LLC has obtained variances from Franklin Township for grading, excavation, and embankment construction necessary to construct the waterline, borehole pad, and access road.

--T-724 - The first variance area for Whites Ridge Road is approximately 0.44 mile (2,280 feet) south from its intersection with Randy Hoge Road (T-475), and continues 140 feet south on both sides of the road.

--T-475 - The variance area for Randy Hoge Road starts 0.47 mile (2,475 feet) south of its intersection with Whites Ridge Road (T-724), and continues 140 feet south on both sides of the road.

--T-724/T-510 - The second variance area for Whites Ridge Road, includes Greenhouse Road (T-510), is approximately 0.46 mile (2,430 feet) north from its intersection with Randy Hoge Road (T-475), and continues 766 feet north.

--T-724/T-487 - The third variance area for Whites Ridge Road/Portal Road starts approximately 0.06 mile (325 feet) south from their intersection and continues 1,090 feet south.

--T-724 - The fourth variance area for Whites Ridge Road is approximately 0.08 mile (390 feet) north from its intersection with Portal Road (T-487), and continues 1,740 feet north.

--T-724 - The fifth variance area for Whites Ridge Road is approximately 0.38 mile (1,980 feet) north from its intersection with Portal Road (T-487), and continues 1,684 feet north.

--T-724 - The sixth variance area for Whites Ridge Road is approximately 1.10 miles (5,830 feet) north from its intersection with Portal Road (T-487), and continues 695 feet north.

The application includes a request for a variance to allow construction within 100 feet of the stream channel for several intermittent and perennial streams. The following stream variances have been requested (including the length, stream name, and an approximate location of the variance):
--31 feet (Intermittent) of Unnamed Tributary 40594 R5 to Pursley Creek. The variance is located on the western side of Whites Ridge Road (T-724) approximately 0.50 miles north of the intersection of Whites Ridge Road (T-724) and Portal Road (T-474). The variance is requested due to the construction of a temporary access road and excavation of an open trench. No direct impacts to Unnamed Tributary 40594 R5 are anticipated as a result of this variance.
--32 feet (Intermittent) of Unnamed Tributary 40594 R5A to Pursley Creek. The variance is located on the western side of Whites Ridge Road (T-724) approximately 0.50 miles north of the intersection of Whites Ridge Road (T-724) and Portal Road (T-474). The variance is requested due to the construction of a temporary access road and excavation of an open trench. No direct impacts to Unnamed Tributary 40594 R5A are anticipated as a result of this variance.
--38 feet (Intermittent) of Unnamed Tributary 40594 R1 to Pursley Creek. The variance is located on the western side of Whites Ridge Road (T-724) approximately 0.18 miles north of the intersection of Whites Ridge Road (T-724) and Portal Road (T-474). The variance is requested due to the construction of a temporary access road and excavation of an open trench. 84 feet of direct impacts to Unnamed Tributary 40594 R1 are anticipated as a result of this variance.
--22 feet (Perennial) of Unnamed Tributary 40594 R1 to Pursley Creek. The variance is located on the western side of Whites Ridge Road (T-724) approximately 0.18 miles north of the intersection of Whites Ridge Road (T-724) and Portal Road (T-474). The variance is requested due to the construction of a temporary access road and excavation of an open trench. The variance is requested due to the construction of a temporary access road and excavation of an open trench. 27 feet of direct impacts to Unnamed Tributary 40471 are anticipated as a result of this variance.
--158 feet (Perennial) of Unnamed Tributary 40482 to Smith Creek. The variance is located on the southern side of Randy Hoge Road (T-475) approximately 0.5 miles east of the intersection of Whites Ridge Road (T-724) and Randy Hoge Road (T-475). The variance is requested due to the construction of a temporary access road and excavation of an open trench. 103 feet of direct impacts to Unnamed Tributary 40482 are anticipated as a result of this variance.
Blasting activity is not proposed for the construction project.

Pursuant to the PENNSYLVANIA CLEAN STREAMS LAW, the PENNSYLVANIA DEPARTMENT OF ENVIRONMENTAL PROTECTION Rules and Regulations, the SURFACE MINING CONSERVATION and RECLAMATION ACT, and the BITUMINOUS MINE SUBSIDENCE and LAND CONSERVATION ACT as amended, notice is hereby given that Emerald Contura, LLC, doing business at P.O. Box 1020, 158 Portal Road, Waynesburg, Pennsylvania 15370, has made application to the Pennsylvania Department of Environmental Protection to revise the mining permit and related NPDES permit to add surface activity site acres for the construction of the West Pool Pipeline Extension and associated EM#4 Pump Borehole pad as well as the existing EM#5 Pump Borehole Site for the Emerald Mine (Permit No. 30841307).

The proposed permit revision will affect 41.34 acres in Center and Franklin Townships, Greene County, Pennsylvania. The proposed pipeline extension route would originate at a location along the permitted West Pool Pipeline (80 13 24.98 Longitude and 39 50 24.09 Latitude), approximately 3,526 feet southeast of the intersection of Oak Forest Road and Hoy Hill Road and end at the existing Emerald Mine CRDA #2 Site located south of Waynesburg, Pennsylvania (80 12 28.62 Longitude and 39 53 11.25 Latitude). The pipeline will traverse approximately 4.1 miles through Franklin Township in Greene County, Pennsylvania. Multiple construction access points to the pipeline project area will be from Whites Ridge Road (T-724) and Portal Road (T-487).

The proposed EM#4 Pump Borehole pad area can be located on the Oak Forest, Pennsylvania U.S.G.S 7.5 minute series topographic map, at approximate 80 13 06.11 Longitude and 39 51 50.29 Latitude. The small borehole pad site is proposed for the construction of two pump boreholes EM#4A (80 13 06.57 Longitude and 39 51 50.63 Latitude) and EM#4B (80 13 05.51 Longitude and 39 51 50.26 Latitude), and supporting facilities relative to the existing Emerald Mine. Access to the site will be from Portal Road (T-487).

The existing 0.97-acre EM#5 Pump Borehole Site is located approximately 2,000 feet northeast of the village of Oak Forest, on a tract of land bounded by Township Road 473 (Hoy Hill Road) on the north, State Road 3013 (Oak Forest Road) on the west, and Township Road 492 (Stewart Run Road) on the south. It can be located on the Oak Forest, Pennsylvania U.S.G.S 7.5 minute series topographic map, at approximate 80 13 48.41 Longitude and 39 50 40.51 Latitude and is located associated with the West Pool Pipeline. It was permitted and constructed by Cumberland Contura, LLC under the Cumberland Mine (Permit No. 30831303, Revision No. 180). This site is being added to the Emerald Mine permit through the permit revision application.

The proposed waterline, EM#4 borehole pad and access road, storm water collection channels, and temporary erosion and sedimentation BMPs (compost filter sock) will be located within 100 feet of the right-of-way for Whites Ridge Road (T-724), Randy Hoge Road (T-475), Greenhouse Road (T-510), and Portal Road (T-487). Emerald Contura, LLC has obtained variances from Franklin Township for grading, excavation, and embankment construction necessary to construct the waterline, borehole pad, and access road.

--T-724 - The first variance area for Whites Ridge Road is approximately 0.44 mile (2,280 feet) south from its intersection with Randy Hoge Road (T-475), and continues 140 feet south on both sides of the road.

--T-475 - The variance area for Randy Hoge Road starts 0.47 mile (2,475 feet) south of its intersection with Whites Ridge Road (T-724), and continues 140 feet south on both sides of the road.

--T-724/T-510 - The second variance area for Whites Ridge Road, includes Greenhouse Road (T-510), is approximately 0.46 mile (2,430 feet) north from its intersection with Randy Hoge Road (T-475), and continues 766 feet north.

--T-724/T-487 - The third variance area for Whites Ridge Road/Portal Road starts approximately 0.06 mile (325 feet) south from their intersection and continues 1,090 feet south.

--T-724 - The fourth variance area for Whites Ridge Road is approximately 0.08 mile (390 feet) north from its intersection with Portal Road (T-487), and continues 1,740 feet north.

--T-724 - The fifth variance area for Whites Ridge Road is approximately 0.38 mile (1,980 feet) north from its intersection with Portal Road (T-487), and continues 1,684 feet north.

--T-724 - The sixth variance area for Whites Ridge Road is approximately 1.10 miles (5,830 feet) north from its intersection with Portal Road (T-487), and continues 695 feet north.

The application includes a request for a variance to allow construction within 100 feet of the stream channel for several intermittent and perennial streams. The following stream variances have been requested (including the length, stream name, and an approximate location of the variance):
--31 feet (Intermittent) of Unnamed Tributary 40594 R5 to Pursley Creek. The variance is located on the western side of Whites Ridge Road (T-724) approximately 0.50 miles north of the intersection of Whites Ridge Road (T-724) and Portal Road (T-474). The variance is requested due to the construction of a temporary access road and excavation of an open trench. No direct impacts to Unnamed Tributary 40594 R5 are anticipated as a result of this variance.
--32 feet (Intermittent) of Unnamed Tributary 40594 R5A to Pursley Creek. The variance is located on the western side of Whites Ridge Road (T-724) approximately 0.50 miles north of the intersection of Whites Ridge Road (T-724) and Portal Road (T-474). The variance is requested due to the construction of a temporary access road and excavation of an open trench. No direct impacts to Unnamed Tributary 40594 R5A are anticipated as a result of this variance.
--38 feet (Intermittent) of Unnamed Tributary 40594 R1 to Pursley Creek. The variance is located on the western side of Whites Ridge Road (T-724) approximately 0.18 miles north of the intersection of Whites Ridge Road (T-724) and Portal Road (T-474). The variance is requested due to the construction of a temporary access road and excavation of an open trench. 84 feet of direct impacts to Unnamed Tributary 40594 R1 are anticipated as a result of this variance.
--22 feet (Perennial) of Unnamed Tributary 40594 R1 to Pursley Creek. The variance is located on the western side of Whites Ridge Road (T-724) approximately 0.18 miles north of the intersection of Whites Ridge Road (T-724) and Portal Road (T-474). The variance is requested due to the construction of a temporary access road and excavation of an open trench. No direct impacts to Unnamed Tributary 40594 R1 are anticipated as a result of this variance.
--155 feet (Intermittent) of Unnamed Tributary 40467 L1E to Smith Creek. The variance is located on the eastern side of Whites Ridge Road (T-724) approximately 0.98 miles east of the intersection of Whites Ridge Road (T-724) and Oak Forest Road (SR-3013). The variance is requested due to the construction of a temporary access road and excavation of an open trench. No direct impacts to Unnamed Tributary 40467 L1E are anticipated as a result of this variance.
--56 feet (Perennial) of Unnamed Tributary 40471 to Smith Creek. The variance is located on the eastern side of Whites Ridge Road (T-724) approximately 0.25 miles south of the intersection of Whites Ridge Road (T-724) and Portal Road (T-474). The variance is requested due to the construction of a temporary access road and excavation of an open trench. 27 feet of direct impacts to Unnamed Tributary 40471 are anticipated as a result of this variance.
--158 feet (Perennial) of Unnamed Tributary 40482 to Smith Creek. The variance is located on the southern side of Randy Hoge Road (T-475) approximately 0.5 miles east of the intersection of Whites Ridge Road (T-724) and Randy Hoge Road (T-475). The variance is requested due to the construction of a temporary access road and excavation of an open trench. 103 feet of direct impacts to Unnamed Tributary 40482 are anticipated as a result of this variance.
Blasting activity is not proposed for the construction project.

The G1-1 Borehole permit area begins along the eastern side of Deer Park Drive (T-697) approximately 0.4 miles southeast of its intersection with Archer Road (T-337). It continues south along the road for approximately 140 feet, to the east for approximately 1190 feet, to the north for approximately 300 feet and back to the west for approximately 1200 feet. The G1-2A Borehole permit area begins along the northeast side of Archer Road (T-337) near its intersection with Penn Road (T-461) and continues northwest along the road for 560 feet and extends to the northeast 650 feet. The G1-2B Borehole permit area begins along the northern side of Minton Run Road (T-340), approximately 0.3 miles west of its intersection with Parcell Road (T-544). It extends to the northwest approximately 305 feet and then to the southwest 245 feet until it reaches the existing 8 North 1 Powerline permit. It begins again approximately 760 feet northwest along the powerline, off to the western side.
