Pursuant to the Pennsylvania Clean Streams Law, the Pennsylvania Department of Environmental Protection Rules and Regulations, the Surface Mining Conservation and Reclamation Act, and the Bituminous Mine Subsidence and Land Conservation Act as amended, notice is hereby given that Consol Pennsylvania Coal Company LLC, 1000 CONSOL Energy Drive, Canonsburg, PA 15317, has submitted an application to the Pennsylvania Department of Environmental Protection to revise Coal Mining Activity Permit No. 30841317 and related NPDES permit for the Enlow Fork Mine.

The proposed revision adds approximately 18.2 acres of surface permit area for the installation of the G1 Panel Degas Boreholes. The facilities will be located in Morris Township, Washington County, and Morris Township, Greene County, Pennsylvania and are located on the Prosperity, PA U.S. Geological Survey 7.5 minute topographic map. The G1-1 Borehole permit area begins along the eastern side of Deer Park Drive (T-697) approximately 0.4 miles southeast of its intersection with Archer Road (T-337). It continues south along the road for approximately 140 feet, to the east for approximately 1190 feet, to the north for approximately 300 feet and back to the west for approximately 1200 feet. The G1-2A Borehole permit area begins along the northeast side of Archer Road (T-337) near its intersection with Penn Road (T-461) and continues northwest along the road for 560 feet and extends to the northeast 650 feet. The G1-2B Borehole permit area begins along the northern side of Minton Run Road (T-340), approximately 0.3 miles west of its intersection with Parcell Road (T-544). It extends to the northwest approximately 305 feet and then to the southwest 245 feet until it reaches the existing 8 North 1 Powerline permit. It begins again approximately 760 feet northwest along the powerline, off to the western side. It continues along the powerline for approximately 770 feet to the northwest and extends to the west 380 feet. The G1-3 Borehole permit area begins along the northern side of Cabin Road (T-538) approximately 0.3 miles northwest of its intersection with SR 18 and continues along the road for 500 feet. It extends to the northeast 170 feet, to the southeast 400 feet, and to the southwest 290 feet back to the beginning. The proposed permit revision includes construction of four degas boreholes, access roads, soil stockpiles, and erosion and sedimentation control facilities.

The application includes a request for variance to encroach within 100 feet of the right-of-way of the following four roads: Deer Park Drive (T-697) beginning approximately 0.4 miles southeast of its intersection with Archer Road (T-337) and continuing 140 feet to the south; Archer Road (T-337) beginning approximately 130 feet northwest of its intersection with Penn Road (T-461) and continuing 480 feet to the northwest; Minton Run Road (T-340) beginning approximately 1660 feet west of its intersection with Parcell Road (T-544) and continuing 50 feet southwest; and Cabin Road (T-538) beginning approximately 0.3 miles northwest of its intersection with SR 18 and continuing 490 feet to the northwest. The Deer Park Drive variance is required for site access for the G1-1 Borehole. The Archer Road (T-337) variance is required for site access, topsoil stockpile, and erosion and sedimentation control facilities for the G1-2A Borehole. The Minton Run Road variance is required for site access for the G1-2B Borehole. The Cabin Road variance is required for installation of the access road, borehole pad, topsoil stockpile, and erosion and sedimentation control facilities for the G1-3 Borehole.

Stream variance requests are proposed for five tributaries to Short Creek and one tributary to Hamestring Run at the following locations: work within 100 feet of a 180 foot section of UNT 40914 to Short Creek beginning approximately 460 feet northeast of the intersection of Archer Road and Penn Road and continuing downstream in a northerly direction; work within 100 feet of a 300 foot section of UNT 40914-L3 to Short Creek beginning approximately 235 feet northeast of the intersection of Archer Road and Penn Road and continuing downstream in a northeasterly direction; work within 100 feet of a 70 foot section of UNT 40914-R1 beginning approximately 640 feet northeast of the intersection of Archer Road and Penn Road and continuing downstream in a northerly direction;; two sections of variance for work within 100 feet of UNT 40914-L5 to Short Creek - the first located at its headwaters, approximately 615 feet northwest of the intersection of Archer Road and Penn Road and continuing downstream 200 feet in a northeasterly direction; and the second, 270 feet downstream from the first and continuing 220 feet downstream in a easterly direction; a 210 foot section of variance for UNT 40921-L3 to Short Creek, located at its culvert crossing under Cabin Road (T-538), approximately 0.3 miles northwest of the intersection with SR 18, and continuing upstream in a northeasterly direction; and work within 100 feet of a 190 foot section of UNT 40923-R4 to Hamestring Run located at its culvert under Minton Run Road, approximately 1575 feet west of the intersection with Parcell Road. The stream variances for the Short Creek tributaries are required for installation of the G1-2A Borehole facility - including access to the site, pad grading, and installation of erosion and sedimentation control facilities and installation of the G1-3 Borehole Facility - including pad grading and erosion and sedimentation control facilities. Box 1020, 158 Portal Road, Waynesburg, Pennsylvania 15370, has made application to the Pennsylvania Department of Environmental Protection to revise the mining permit and related NPDES permit to add surface activity site acres for the construction of the West Pool Pipeline Extension and associated EM#4 Pump Borehole pad as well as the existing EM#5 Pump Borehole Site for the Emerald Mine (Permit No. 30841307).

The proposed permit revision will affect 41.34 acres in Center and Franklin Townships, Greene County, Pennsylvania. The proposed pipeline extension route would originate at a location along the permitted West Pool Pipeline (80 13 24.98 Longitude and 39 50 24.09 Latitude), approximately 3,526 feet southeast of the intersection of Oak Forest Road and Hoy Hill Road and end at the existing Emerald Mine CRDA #2 Site located south of Waynesburg, Pennsylvania (80 12 28.62 Longitude and 39 53 11.25 Latitude). The pipeline will traverse approximately 4.1 miles through Franklin Township in Greene County, Pennsylvania. The proposed EM#4 Pump Borehole pad area can be located on the Oak Forest, Pennsylvania U.S.G.S 7.5 minute series topographic map, at approximate 80 13 06.11 Longitude and 39 51 50.29 Latitude. The small borehole pad site is proposed for the construction of two pump boreholes EM#4A (80 13 06.57 Longitude and 39 51 50.63 Latitude) and EM#4B (80 13 05.51 Longitude and 39 51 50.26 Latitude), and supporting facilities relative to the existing Emerald Mine. Access to the site will be from Portal Road (T-487).

The existing 0.97-acre EM#5 Pump Borehole Site is located approximately 2,000 feet northeast of the village of Oak Forest, on a tract of land bounded by Township Road 473 (Hoy Hill Road) on the north, State Road 3013 (Oak Forest Road) on the west, and Township Road 492 (Stewart Run Road) on the south. The proposed waterline, EM#4 borehole pad and access road, storm water collection channels, and temporary erosion and sedimentation BMPs (compost filter sock) will be located within 100 feet of the right-of-way for Whites Ridge Road (T-724), Randy Hoge Road (T-475), Greenhouse Road (T-510), and Portal Road (T-487). Emerald Contura, LLC has obtained variances from Franklin Township for grading, excavation, and embankment construction necessary to construct the waterline, borehole pad, and access road.
