Pursuant to the Pennsylvania Clean Streams Law, the Pennsylvania Department of Environmental Protection Rules and Regulations, the Surface Mining Conservation and Reclamation Act, and the Bituminous Mine Subsidence and Land Conservation Act as amended, notice is hereby given that Consol Pennsylvania Coal Company LLC, 1000 CONSOL Energy Drive, Canonsburg, PA 15317, has submitted an application to the Pennsylvania Department of Environmental Protection to revise Coal Mining Activity Permit (CMAP) No. 30841316 and related NPDES permit for the Bailey Mine.

The proposed revision adds approximately 43.4 acres of surface permit area for construction of the 6 South 3 Facility. The project is located in Aleppo Township, Greene County, Pennsylvania and is located on the New Freeport, PA U.S. Geological Survey 7.5 minute topographic map. The proposed permit area begins at the existing 15I Bleeder Shaft access road off of SR 3018 (Behm Road), near its intersection with SR 3001 (Aleppo Road). It extends to the northwest approximately 1800 feet, to the northeast approximately 3300 feet, and encompasses several existing Bailey Mine permit areas. It continues in a north, northeasterly direction for approximately 2800 feet. The proposed permit revision includes construction of the portal, a warehouse, office, bathhouse, substation, guardhouse, sewage treatment plant, water tanks, boreholes, and parking area. The proposed permit revision also includes an access road off of Behm Road, soil stockpiles, relocation of a waterline and powerline, a sediment pond, and other erosion and sedimentation control facilities.

The application includes a request for variance to encroach within 100 feet of the right of way of SR 3018 (Behm Road) and SR 3001 (Aleppo Road). The SR 3018 road variance begins approximately 230 feet east of its intersection with SR 3001 and continues 640 feet to the east. The SR 3001 variance begins approximately 1445 feet northwest of its intersection with SR 3018 and continues 140 feet to the northwest. The road variances are required for widening the existing access road, installation of a sewage treatment plant discharge pipe, sediment pond outlet pipe, a contractor laydown area, and erosion and sedimentation control facilities.

A stream variance request is proposed for South Fork Dunkard Fork as follows: A 150 foot section of variance is requested, beginning approximately 2300 feet downstream of its confluence with Blacks Creek (located near the intersection of Aleppo Road and Behm Road) and continuing downstream in a northwesterly direction. The stream variance is required for installation of the sediment pond and sewage treatment plant discharge pipes and outfalls.

The proposed permit revision includes one new NPDES discharge point from the proposed sedimentation pond into South Fork Dunkard. Pursuant to the Pennsylvania Clean Streams Law, the Pennsylvania Department of Environmental Protection Rules and Regulations, the Surface Mining Conservation and Reclamation Act, and the Bituminous Mine Subsidence and Land Conservation Act as amended, notice is hereby given that Consol Pennsylvania Coal Company LLC, 1000 CONSOL Energy Drive, Canonsburg, PA 15317, has submitted an application to the Pennsylvania Department of Environmental Protection to revise Coal Mining Activity Permit No. 30121301 and related NPDES permit for the Harvey Mine.

The proposed revision adds approximately 6.3 acres of surface permit area for the installation of the 5A-2 and 5A-3 Degas Boreholes. The facilities will be located in Morris Township, Greene County, Pennsylvania and are located on the Rogersville, PA U.S. Geological Survey 7.5 minute topographic map. The 5A-2 Borehole permit area begins along the eastern side of SR 4015 (Webster Road) approximately 1340 feet south of its intersection with Mankey Road (T-426). It continues in a southeasterly direction for approximately 1200 feet, varying in width between 30 and 140 feet. It then continues in a northeasterly direction for approximately 865 feet, varying in width from 110 and 275 feet The 5A-3 Borehole permit area is located along Baldwin Hollow Road (T-601), beginning approximately 0.6 miles south/west of its intersection with SR 18 (Browns Creek Road) and continuing to the west 310 feet. It extends off the southern side of Baldwin Hollow Road 105 feet. The proposed permit revision includes construction of two degas boreholes, access roads, soil stockpiles, and erosion and sedimentation control facilities.

The application includes a request for variance to encroach within 100 feet of the right-of-way of Baldwin Hollow Road (T-601) beginning approximately 0.6 miles south/west of its intersection with SR 18 (Browns Creek Road) and continuing approximately 310 feet to the west. The road variance is required for installation of an access road, the borehole pad, stockpile, and erosion and sedimentation control facilities for the 5A-3 Borehole.

Stream variance requests are proposed for two UNTs to Browns Creek as follows: A variance is requested for work within 100 feet of UNT 40574 beginning off the southern side of Baldwin Hollow Road (T-601) approximately 0.6 miles south/west of its intersection with SR 18 (Browns Creek Road) and continuing approximately 310 feet to the west, in an upstream direction. An 85 foot section of variance is also requested for UNT 40574-L13, beginning at the culvert under Baldwin Hollow Road (located approximately 0.63 miles south/west of its intersection with SR 18) and continuing downstream to its confluence with UNT 40574. The stream variances are required for access road installation, borehole installation, a topsoil stockpile, and installation of erosion and sedimentation control facilities for the 5A-3 Borehole.
