JANUARY 19, 2021
NOTICE IS HEREBY GIVEN that in response to a proposal from Stuart Wright, of Wright and Stevens to annex 4.18 acres located on the west side of the intersection of Florida Road and Colorado Avenue, to
be known as the Cummins Addition, the Durango City Council unanimously adopted the following Resolution at its regular meeting of December 15, 2020.
A RESOLUTION ACCEPTING A PETITION FOR ANNEXATION AND INITIAL ZONING OF THE CUMMINS ADDITION ANNEXATION TO THE CITY OF DURANGO AND SETTING A PUBLIC HEARING FOR JANUARY 19, 2021.
WHEREAS, the owners of 100% of the territory described on Exhibit A attached hereto have filed a Petition with the City Council of the City of Durango requesting that the Council accept said Petition and by ordinance approve the annexation of said property which is situated, lying and being in the County of La Plata, State of Colorado, to be known as the Cummins Addition to the City of Durango; and
WHEREAS, the Annexation Petition is accompanied by a map of the territory to be annexed and the relationship of its boundaries to the established corporate limits of the City of Durango; and
WHEREAS, a request for initial zoning of PD (Planned Development) for the property located at western corner on the intersection of Colorado Avenue and Florida Road, identified as parcel number 566521200091, for approximately 4.18 acres is being processed concurrently with the annexation request; and
WHEREAS, the territory is eligible for annexation to the City of Durango under the laws of the State of Colorado, and the Petition and Annexation and the documents thereto attached meet the requirements of the statutes of the State of Colorado; and
WHEREAS, the City finds substantial compliance with said State statutes in that the territory to be annexed is specifically greater than one-sixth contiguous to existing corporate limits, has a community of interest with the City of Durango, is urban or will be urbanized in the near future, and is integrated or capable of being integrated with the City of Durango, and
WHEREAS, the proposed annexation will not extend Durangos municipal boundary more than three miles in any direction from any point of such municipal boundary in any one year;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Durango, in regular meeting assembled, that: said petition is hereby accepted that a public hearing on the annexation and initial zoning be legally noticed in accordance with State statutes for 6:30 p.m. on the 19th day of January 2021, at the Council Chambers, Durango City Hall, 949 E 2nd Avenue, Durango, Colorado, 81301.

NOTICE IS FURTHER GIVEN that said property is vacant and is an enclave of unincorporated La Plata County. The property would have an initial zoning of PD (Planned Development). The proposed project at this location would consist of up to 35 housing units consisting of single-family homes, townhouses and patio homes. Council reviewed a project proposal from the same applicants at this location during the summer and fall of 2020. At that time, the proposed project had two access points, one to Colorado Avenue and one to Ryler Drive. The applicants withdrew that proposal and have submitted the new project design which features one access point, onto Colorado Avenue.
THE PUBLIC IS INVITED to submit written testimony regarding this proposal. Written comments from those who want their opinions considered in Councils deliberations must be received by noon on Monday, January 18, 2020 in the City Clerks office via email to PublicComment@durangogov.org. Each email should contain the corresponding agenda item in the subject line of the email. The senders full name and address should be included for the record. If comment by email is not possible, comments may also be placed in the drop box located in front of City Hall, 949 East 2nd Avenue, no later than noon on Monday, January 18, 2021.
